#52 Ancestors: Where there’s a Will

Join me as I share my ancestor’s will and annotations. Don’t forget to contact me if we’re related.

In the name of God Amen I Joseph Brundige of the town of Minisink in Orange County being sick and weak in body but of sound mind memory and understanding do make and publish this my last will and testament in manner following that is to say

When Joseph prepared his will Feb. 2, 1830, 4th Great Grandfather was 60 years of age. The section in Minisink where Joseph Brundage lived would later become the town of Wawayanda.

First I give and devise to my sons Orzimus C., William T., Samuel, Abijah, Mastin and Merrit all my real estate consisting of about one hundred and twenty acres of land to hold to their and to their heirs and assigns forever subject to the legacies charges and conditions herein after mentioned

Great Grandfather purchased several pieces of land in the Minisink area according to deeds at the Orange County Government Center, Goshen, NY.  On Sept. 24, 1804 he acquired 61 and 3/4 acres from John Green and his wife Cloe. [Deeds Liber L, page 78.]  The June 15, 1813 issue of the Orange County Gazette reported the 61 3/4 acres was slated to be sold for non-payment of interest.

In March of 1815, Joseph bought 70 acres he formerly owned from Holloway Stephens and wife Amy. [Deeds Liber 39, page 189.]  Joshua Mulock and wife Sarah sold him 50 acres Jan. 4, 1823.  [Deeds Liber 39, page 191.]

also I give and devise to my six sons before named all my personal property of whatever nature or kind except as in herein after excepted,

That would be the six who shared the120 acres.

also I give and bequeath to my oldest son Epenetus Two hundred Dollars to be paid to him when my youngest son shall attain to the age of twenty one years,

It sounds like Epenetus didn’t take to farming. According to his father’s wishes, he needed to wait until the youngest boy became 21 years old (1845) before he could collect the $200.

Also I give and bequeath to my daughter Rosanah Brundige one hundred and fifty Dollars for an outset which I consider equivalent to the portions which I have already given to her sisters Azubah King and Sophia Knapp the said legacy to be paid to her when she shall be married, or if she should continue single when her youngest brother shall arrive at the age of twenty one and until one or the other of the said events shall happen my will is that she shall live at home with the family and be supported out of the proceeds of the property but if my said daughter Rosanah should die without being married and before her youngest brother shall attain to the age of twenty one years I then will and order that her legacy be distributed equally amongst all her surviving brothers and sisters

As you probably guessed, Rosanna was a girl when Joseph planned for her future without him. He had already provided for his married daughters Azubah and Sophia. Isaac P. King was Azubah’s husband and Sophia married Nathaniel Knapp.

also I give and bequeath to my wife Martha Brundige three cows and six sheep to be kept upon the farm also my clock and family Bible

What happened to the Bible? Did 4th Great Grandmother entrust it to one of the children and if so, which one?

she is also to be provided with a horse and wagon as often as she shall request the same and my desire is that she shall continue upon the farm and take the charge of my younger children,  Also to the end that my family may be kept together and that my younger children may have a home and a support

it is my will that all the stock and farming utensils which I may have at the time of my decease shall be continued upon the farm and farther that there shall be no partition or division of my estate either real or personal until my youngest son shall arrive at the full age of twenty one years

If I can rely on census records, Martha Brundage was 47 when Joseph passed. Great Grandfather definitely wanted her to remain on the farm until their youngest boy Masten reached his majority in 1845. Joseph needn’t worry about his land as his son Orsamus C. retained it by buying out his brothers.

I further order that the surplus funds arising from my estate if there should be any after defraying the necessary expenses of the family and after discharging such debts as are outstanding at the time of my death shall be appropriated to the erection of suitable buildings and in making such other necessary improvements upon the farm as shall be deemed advisable and proper

It’s a shame Great Grandfather Joseph died two years after the will was drawn up on Feb. 4, 1832. His thoughtfulness and love for his family and farm are evident. Ten children including six that were not yet 21 years old grieved their father.

Also I will and order that if any of my sons should die without leaving lawful issue before my youngest son shall arrive to the age of twenty one years then the share or shares of such deceased son or sons shall be distributed equally amongst his surviving brothers

I do hereby constitute and appoint my wife Martha Brundige Executrix and my son Orzimus Brundige and my son in law Nathaniel Knapp Executors of this my last will and testament

Nathaniel Knapp declined to serve as an executor April 30, 1832.

In witness where of I have signed sealed published and declared by the testator as and for his last will and testament in our presence who at his request in his presence and in the presence of each other have subscribed our names as witnesses thereto

On March 15, 1832, Joseph Brundage's will was probated. An inventory was conducted by Abijah Wells and Jonathan Tuthill June 20, 1832 appraising his property to be worth $849.22.  (Inventory on file at Orange Co., NY Surrogate Court)

I’m on the lookout for Joseph Brundage’s bible. Brundage family researchers, can you help?

Notes

Orsamus C. Brundage was a successful farmer in the Town of Wawayanda, Orange Co., NY for many years. According to the Agricultural Statistics prepared with the 1875 New York State Census, he owned 130 acres. The cash value of his farm was $12,000. His farm buildings (other than his dwelling) were estimated at $1,000; his stock $1,500; tools and implements $200. The gross sales generated from his farm in 1874 were stated to be $2,000. His property included 100 apple trees, 75 pasture acres, and 50 meadow acres.

Orsamus C. Brundage was a lifelong resident of the Town of Wawayanda. About 1843, Orsamus was a Leader at the Old Rome Church in Minisink [Orange Co. Gen. Soc. Quarterly, Feb. 1981]. Ruttenber & Clark's "History of Orange County, New York", published in the early 1880's, page 688, states he was a trustee with the Centreville Methodist Episcopal Church.

The land records at the Orange County, NY Government Center in Goshen, NY indicate Orsamus acquired a lot of land throughout his lifetime. He inherited a share of his father's 120 acres in 1832 along with his brothers, William T., Samuel, Abijah, Masten, and Merit. Orsamus was also an executor for his father's will as well as a brother-in-law Nathaniel Knapp.

According to Mortgage Book 36, page 528, Orsamus C. Brundage and Mariah, his wife, borrowed $500.00 from Nathaniel Knapp, a brother-in-law. The mortgage was paid per Liber 42 and recorded April 25, 1836. He purchased two parcels of land in Minisink belonging to Levi S. Young April 1, 1840 [Deed Book 72, pg 528] containing about 52 acres.

Orsamus' brother, William T. Brundage, sold his 1/6 share of the property he inherited from his father to Orsamus for $800.00 Jan. 17, 1842 [Deed Book 72, pg 553].

On Dec. 4, 1840 another brother, Samuel and his wife Miranda who had relocated to Auburn, Susquehanna Co., PA, sold his share of their father's lands to Orsamus for $600. This deed [Book 73, pg 1] was also recorded Jan. 17, 1842.

Orsamus bought property that had belonged to his mother Sept. 7, 1843 [Deed Book 81, pg 441] that had been seized by the Sherrif and sold at public venue. This included several lots covering about 80 acres.

Rosannah, Orsamus' sister, and her husband William Kimber sold 9 3/4 acres to Orsamus Jan. 7, 1843 [Deed Book 82, pg 212].

Merit C. Brundage, another brother, sold his holdings he had from his father March 31, 1846 [Deed Book 88, pg 280] to Orsamus.

He purchased 61 and 3/4 acres from the Commission for Loaning Money for Orange County Sept. 21, 1846.

Abijah Brundage, brother, sold his property he had received from their father Feb. 25, 1850 [Deed Book 104, pg 212].

Samuel Elston of Sussex Co., NJ sold a 3 acre lot in Minisink to Orsamus March 30, 1850 [Deed Book 115, pg 119].

Finally on March 29, 1860 the last of his brothers, Masten, sold his property to him [Deed Book 162, pg 82].

On August 7, 1861 Wm. H. Hoyt of Tioga Co., NY sold Orsamus 30 acres in Wawayanda that bordered his property [Deed Book 164, pg 224].

Linden Mulford deeded 74 1/4 acres in Wawayanda to Orsamus C. Brundage April 2, 1866 [Deed Book 195, pg 459]. Orsamus later sold Linden Mulford's property to Sylvester Giveans Feb. 17, 1879 [Deed Book 292, pg 295].

On Dec. 20, 1837, Joseph Kimber of Minisink borrowed $300 from Orsamus C. Brundage.  The mortgage was paid Sept. 15, 1838. At this date, there were two men named Joseph Kimber living in Minisink so it's difficult to say with certainty if this was Orsamus C. Brundage's brother-in-law.

Very close to Orsamus' death--Feb. 23, 1888 he sold some of his property to Charles A. Pauley for $5,000.00. This sale included a farm containing 46 acres, 1/4 and six rods that had originally belonged to his father, Joseph Brundage. Also a small lot--5 and 3/4 acres and 10 rods that Orsamus had purchased from Levi S. Young's estate; the land he got from the Commission for Loaning Money for Orange County--61 and 3/4 acres; 30 acres Orsamus purchased from Wm. H. Hoyt; 20 acres that had belonged to his sister and her husband Isaac P. King; and 9 acres and 1 rod that had belonged to Joseph Brundage were included in this transaction. (Deed Book 356, pg 476)

A newspaper from Wantage, Sussex Co., NJ , the "Wantage Recorder" dated March 26, 1937 reported a brother’s death in William J. Coulter's genealogical column:

"Merrit C. Brundage dec'd, Dec. 29, 1867 (buried on David Slawson farm a short distance from Stewarttown School house (in Town of Wawayanda, Orange Co., NY)  His father was Joseph Brundage, buried by Orsa Brundage."

A search of available newspapers on microfilm at Thrall Library, Middletown, NY proved unsuccessful in locating an obituary for Orsamus C. Brundage.

An earlier post titled Census Sunday, Orsamus C. Brundage Family, Wawayanda, New York was published August 10, 2014.

Census Sunday, Orsamus C. Brundage Family, Wawayanda, New York

The 1865 New York State census is a genealogical gem! Just a few months after the Civil War ended my 3rd Great Grandparents Orsamus C. Brundage and Phebe Maria Kimber appeared in the June 28, 1865 enumeration in Wawayanda, Orange Co., New York.

1865 New York State Census
Town of Waywayanda, Orange County
Partial Page 44, Lines 1 - 11

Line 7 is 3rd Great Grandfather Orsamus C. Brundage. His dwelling was a framed house valued at $300. His was the 318th family the census taker, Mr. N. E. Pierson, visited. Mr. Pierson used only initials for given names for much of Wawayanda. The census tells us Orsamus was 57 years old, born in Orange County, a farmer and a native. The census doesn’t indicate this but Orsamus owned the land as well as I. S. Brundage’s property.

3rd Great Grandmother Phebe Maria (Kimber) Brundage was line 8. She was 52 years old, a wife, born in New Jersey, mother of 7 children, married 1 time and currently married.

Lines 9, 10, and 11 are Orsamus and Phebe Maria’s children, John L., Charles Emet and Ellagene. They were born in Orange County with the eldest boy, John L., working as a laborer.

A married son and his family were residing in a framed house right next door (dwelling #308, family visited #316) worth $200 (on lines 1 through 4). Ira S. Brundage was employed as a laborer and was born in Orange County. He was married and it was his first marriage to Crissa Jane Tears. Crissa Jane was the mother of Alice and Hattie both born in Orange County like their parents.

In the same home with Ira but assigned family #317 were A. Kimber and M. Knapp. A. Kimber was Abigail Kimber, 74 years old, born in Orange County, mother of 8 children, married 1 time and widowed. Abigail was the grandmother of Ira, mother-in-law to Orsamus C. and mother to Phebe Maria. Eighty year old M. Knapp lived with Abigail. She had married 2 times and was also a widow. This might be Abigail’s sister.

Orsamus C. and Phebe Maria Brundage were my 3rd Great Grandparents, their daughter Emily married Richard Wight, their daughter Emily Wight married Lewis Penny Doty who were the parents of my grandfather, Frank Leroy Doty.
